RECENT MATTERS
Arnold Bloch Leibler acted for six former non-executive directors of The Star Entertainment Group in civil penalty proceedings brought by ASIC in the Federal Court of Australia.
The matter was one of the most significant and closely watched directors' duties cases in recent years, followed closely by directors and advisers across the ASX-listed corporate landscape. ASIC alleged that the former non-executive directors had breached their duty of care and diligence, principally in relation to The Star's dealings with overseas gambling junket operators.
Following a lengthy trial in 2025, Justice Lee dismissed ASIC's case against the non-executive directors in March 2026, finding that ASIC had failed to establish that they had breached their duties. His Honour did, however, find that certain relevant executives had breached theirs.
The proceeding raised important issues of corporate governance, board oversight and the responsibilities of non-executive directors in complex, highly regulated businesses. It was a high-stakes and intensely scrutinised matter, involving serious allegations against experienced directors.
